陕西省高级人民法院发布“三个意见”强化秦岭黄河汉江生态环境保护工作
5月8日，陕西省高院发布了《关于全面加强秦岭生态环境司法保护工作的意见》、《关于全面加强黄河流域生态环境司法保护工作的意见》以及《关于全面加强汉江流域生态环境司法保护工作的意见》（以下简称“三个意见”）。这次发布的文件旨在进一步加强对秦岭、黄河流域和汉江流域生态环境的司法保护。
据了解，“三个意见”分别为全省法院提供了具体要求，指导如何在审理涉及这些地区案件时提高效率和质量。其中，《关于全面加强秦岭生态环境司法保护工作的意见》共有3个部分20条；《关于全面加强黄河流域生态环境司法保护工作的意见》共有3个部分22条；《关于全面加强汉江流域生态环境司法protectsion Work of the Three Opinions
On May 8, the Higher People's Court of Shaanxi Province issued the "Three Opinions" on strengthening the judicial protection of ecological environments in Qinling Mountains, Yellow River Basin, and Han River Basin. These opinions aim to further enhance judicial protection for these regions' ecological environments.
According to reports, each opinion includes specific requirements for courts at all levels in Shaanxi Province to improve their handling of cases related to these areas. The three opinions cover a total of 60 articles across nine aspects: pollution prevention and control, resource utilization, biodiversity conservation, development and construction projects, cultural heritage preservation and promotion, public interest litigation involving environmental issues, trial procedures for environmental damage compensation cases, enforcement proceedings related to environmental protection fines or penalties imposed by administrative law enforcement authorities.
Shaanxi Provincial Deputy Procurator-General Zhang Xingren emphasized that implementing these opinions will require judges at all levels in Shaanxi Province to adopt a proactive approach when handling such cases. They must ensure that court decisions are based on thorough investigations into facts and evidence while also considering broader social implications. This will help create a strong legal foundation for protecting the ecological environment in Qinling MountainsYellow River BasinHanjiang River Basinand contribute effectivelyto safeguarding China's economic and social development.
In recent yearsShaannxiprovincial courts have taken steps towards building an efficient systemforjudgingenvironmental resources-relatedcaseswith high-quality judgments outcomes,and execution rates above average. Two case studies from this region were recognized by UN Environment Programme as one of China's ten exemplary cases involving environmental resources management; two more were selected as model cases by Supreme People's Court (SPC) Supreme People's Procuratorate (SPP).
