2024年1-5月，我在喀什地区生态环境系统中，参与了继续深入打好污染防治攻坚战的努力。我们加大了执法力度，结合日常检查、信访举报、“双随机”检查、环境专项执法，严厉打击了环境违法行为。现在，我要向大家公布喀什地区2024年第一批3起生态环境违法典型案例。
案例一：叶城某公司逃避监管方式排放水污染物案
一、案件简介
根据我收到的信访投诉信息，2023年12月，我赶往现场核查信访反映的问题。经调查发现，叶城县某公司于2023年11月中标叶城县某乡小学污水处理服务项目，将污水违法倾倒到叶城县某乡空地。我对此立案调查。
二、查处情况
叶城县某公司以逃避监管的方式排放水污染物的行为违反了《水污染防治法》第三十九条的规定。我依据《水污染防治法》第八十三条第三项规定，对该公司于2024年3月29日处以11.46万元罚款，并将案件移送公安机关，对相关责任人实施行政拘留。
三、典型意义
1.通过加大生态环境宣传，我积极引导公众发现和举报环境违法问题，形成全社会共同参与打击环境违法行为的良好氛围。
2.充分运用“四个配套办法”，及时启动行政与司 法联动机制，将案件移送公安机关，在严厉打击逃避监管方式排放污染物违法行为的同时，起到了一定的震慑效应。
案例二：疏勒县某公司未保证大气污染物排放自动监测设备正常运行案
一、 案件简介
2023年10月，我对疏勒县某公司进行现场执法人工检查时发现，该公司废气排放口安装的烟气自动监测设备未按照《固定污染源烟气排放连续监测技术规范》要求运行。
二、 查处情况
疏勒县某公司未保证大气污染物排放自动监测设备正常运行行为违反了《大气 污染防治法》第二十四条第一款规定。我依据《大 气 污染防治 法》第一百条第三项规定，对该 公司于 20 24 年 1 月 5 日处以2.9万元罚款。
三、启示意义

Case Three: A Company in Kashgar City Fails to Fill Out a Pollution Registration Form
One: Case Summary
In October 2023, I conducted a joint inspection with other departments on a company in Kashgar City as part of the "double random" one public check-up campaign. According to the requirements of the "Classification Catalogue for Environmental Pollution Source Permit Management (2019 Edition)", this company should have filled out a pollution registration form. However, during the inspection, they were unable to provide us with a pollution permit registration form or any information about it on the national pollution permit management information platform.
Two: Penalty Situation
The company's failure to fill out a pollution registration form violated Article Twenty-fourth Paragraph One of "Regulations on Environmental Pollution Permit Management". Based on Notice No., I exempted this case from administrative penalties as stipulated by item two under “List of Exempted Cases from Administrative Penalties (Version 20XX)”.
Three: Implication Significance
The pollution permit is an essential system for managing fixed pollutants sources and serves as evidence for environmental supervision over polluting enterprises.
